			<content:encoded><![CDATA[<p>It was recently reported that a North County man pleaded guilty to felony burglary and vandalism charges. Jovan Peter Araujo was sentenced to one year in jail, three years of probation, and ordered to pay over $10,000 in restitution costs.</p>
<p>Araujo and a 17-year-old minor would host parties in vacant upscale homes while the owners were away. They would inform party-goers by text message and charge for entrance. Araujo was on probation when he was arrested. He had been convicted of the same charges in the past.</p>
<p><a href="http://www.wklaw.com/burglary-types.html">Burglary is defined under California Penal Code Section 459</a> as entering a building, vehicle, vessel or cargo container with the intention of either stealing something or committing a felony. The state does not need to prove that you succeeded in stealing or committing a felony; it must only prove that you intended to. There are two types of burglary in California: burglaries committed in someone&#8217;s home are first-degree burglaries, which are always felonies (residential burglary); all other types are second-degree burglaries that may be charged as misdemeanors or felonies (commercial burglary). Araujo’s charges fall under the category of first-degree burglary. A first-degree burglary charge can result in a prison sentence of up to six years and is classified as a strike under California’s Three Strikes Laws. The lawyer asked the Wallin &#038; Klarich attorney in our San Diego office whether the felony could be reduced to a misdemeanor after the defendant was released from prison.</p>
<p>Our <a href="http://www.wklaw-sandiego.com/">San Diego Wallin and Klarich attorney</a> explained that there are some crimes that be charged as either felonies or misdemeanors. Criminal defense lawyers call these crimes “wobblers.” If a defendant is convicted of a felony wobbler and sentenced to jail and probation, he can later ask the judge to reduce the felony to a misdemeanor. However, if a defendant is convicted of a felony wobbler and is sentenced to prison and parole, he cannot later ask the judge to reduce the felony to a misdemeanor.</p>

			<content:encoded><![CDATA[<p>Two teenagers were recently taken into custody after a hit and run accident in San Diego that left another teen in the hospital.  <a href="http://www.10news.com/news/21358946/detail.html">San Diego Channel 10 News</a> reported the story after the incident which occurred in Otay Mesa.  According to witnesses, the hospitalized teen was driving his car near the intersection of Beyer Way and Picador Boulevard when he was struck by a SUV.  The SUV left the scene but was followed by another witness who contacted the police.  The police later arrested the two teenagers who were in the SUV.</p>
<p>In the state of California, it is mandatory to stop when involved in an accident.  The driver must attempt to locate and notify the owner of the damaged property and produce his/her driver’s license and proof of insurance. If the driver does not stop, he/she could be charged with a hit and run. A hit and run charge can either be filed as a misdemeanor or felony. The charge is usually determined by the level of seriousness of the accident. If there was minimal property damage and no one was injured, the San Diego prosecutors typically charge the crime as a misdemeanor.  Penalties can include jail time, fines up to $1000, and possible license suspension. If the accident caused injury or death, the charge will most likely be filed in San Diego as a felony. Penalties can include 4 years in state prison, substantial fines, and loss of driver’s license. </p>

Thorbes was convicted of false impersonation, two counts of stealing, and commercial burglary in San Diego County. She stole over $72,000 from both dentists and dental patients while being employed at various dental offices in San Diego County.  She plead guilty and was sentenced to five years and four months in prison. A recommendation of her plea agreement included that she be permitted to serve her sentence in a drug rehabilitation facility run by the Department of Corrections. The judge in the case also sentenced her to pay restitution to her victims.</p>
