			<content:encoded><![CDATA[<p>It was recently reported that a former hospital worker was sentenced to three years in state prison for stealing more than $300,000 cash from cash registers at the hospital’s cafeteria.  Bridget Dominique Ganier worked as an executive assistant, which required her to supervise the daily cafeteria revenues and deposits.  This is when she stole the money.  The money was routed to her personal account where she purchased several real estate properties.  She was found guilty of <a href="http://www.wklaw.com/areas-theft.html">grand theft</a> crimes and sentenced to three years in state prison.</p>
<p>Under California Penal Code Section 487, a grand theft crime is committed when the money, labor, or real or personal property taken is of a value exceeding $400.  Grand theft is punishable by imprisonment in state prison for up to three years.  Restitution can also be ordered.  In this case, Ganier was ordered to pay $306,000 in restitution. </p>

			<content:encoded><![CDATA[<p>Paulette Dastrup Thompson, the former principal at Reynolds Elementary School in Oceanside, was recently sentenced after she entered a guilty plea to <a href="http://www.wklawtheft.com/grand-theft.html">grand theft in Southern California</a> and misappropriation of public funds. <a href="http://www.sandiego6.com/news/local/story/Ex-Principal-Gets-Jail-Time-for-Thefts/nhdZzCpJrkS1uEdUNZICiw.cspx">San Diego 6 News</a> recently reported that Thompson will serve 90 days in jail and five years probation.  </p>
<p>Thompson had been an educator for over 30 years when she was arrested for stealing over $100,000 from two PTA’s and the Oceanside school district. Through the use of checks and money wiring, Thompson used the stolen money for herself and family members. There will be another hearing to determine the exact amount of Thompson’s liability and how she will pay restitution. As part of Thompson’s sentence, the judge also imposed 400 hours of community service at a nonprofit organization.  </p>

			<content:encoded><![CDATA[<p>It was recently reported that a San Diego woman was sentenced to 13 years and 8 months in prison after pleading guilty to kidnapping and car jacking charges. Crystal Lynn Buckingham pleaded guilty to avoid a jury trial, in which she could have been sentenced to life imprisonment if found guilty. Buckingham car jacked and kidnapped a woman in a La Mesa mall parking lot in December 2008. Buckingham used a gun in the incident. The victim escaped by jumping out of the car.</p>
<p>Car jacking is defined as the theft of a vehicle by using force or fear. Penalties for a car jacking conviction range from nine years to life in prison, depending on the circumstances. When a kidnapping occurs during the course of a car jacking, California law states that the penalty is life in prison with the possibility of parole. 			<content:encoded><![CDATA[<p>It was recently reported that a North County man pleaded guilty to felony burglary and vandalism charges. Jovan Peter Araujo was sentenced to one year in jail, three years of probation, and ordered to pay over $10,000 in restitution costs.</p>
<p>Araujo and a 17-year-old minor would host parties in vacant upscale homes while the owners were away. They would inform party-goers by text message and charge for entrance. Araujo was on probation when he was arrested. He had been convicted of the same charges in the past.</p>
<p><a href="http://www.wklaw.com/burglary-types.html">Burglary is defined under California Penal Code Section 459</a> as entering a building, vehicle, vessel or cargo container with the intention of either stealing something or committing a felony. The state does not need to prove that you succeeded in stealing or committing a felony; it must only prove that you intended to. There are two types of burglary in California: burglaries committed in someone&#8217;s home are first-degree burglaries, which are always felonies (residential burglary); all other types are second-degree burglaries that may be charged as misdemeanors or felonies (commercial burglary). Araujo’s charges fall under the category of first-degree burglary. A first-degree burglary charge can result in a prison sentence of up to six years and is classified as a strike under California’s Three Strikes Laws. Gladys Escobar, who now resides in Los Angeles, was sentenced to three years probation (with a five year, fourth month prison sentence suspended), 120 hours of community service, and was ordered to pay the victims $8,730 in restitution.</p>
<p>Grand theft is a felony charge that results when the value of the property illegally taken is over $400.  Theft charges can stem from incidents such as the one above in which Escobar defrauded people but they can also occur when a person illegally takes property from another with the intent of keeping the property indefinitely.</p>

			<content:encoded><![CDATA[<p>Raul Casillas, of Chula Vista, was taken into custody after pleading not guilty to charges surrounding a scam he was allegedly running. <a href="http://www.cbs8.com/Global/story.asp?S=11713854">CBS 8 of San Diego</a> reported on the scam story. Casillas posed as a contractor using another person’s contractor license. The victims in the scam were all elderly. Casillas would take their money and then stop working on the jobs. He is facing two counts of financial elder abuse, three counts of grand theft, and eight counts of residential burglary.</p>
<p>Residential burglary is defined as entering a building that serves as a residence or is habitable with the intent to steal or commit any felony. Grand theft is defined as illegally taking the property, valued over $400, of another against their will or knowledge with the intent to keep the property and deny the owner of the property. A conviction for either of these crimes carries serious penalties of jail time and fines.</p>

The vehicle he used for the robbery was identified and helped police locate and later arrest him.</p>

			<content:encoded><![CDATA[<p>San Diego Channel 6 recently reported a story on Emily Marie Thorbes. Thorbes was convicted of false impersonation, two counts of stealing, and commercial burglary in San Diego County. She stole over $72,000 from both dentists and dental patients while being employed at various dental offices in San Diego County.  She plead guilty and was sentenced to five years and four months in prison. A recommendation of her plea agreement included that she be permitted to serve her sentence in a drug rehabilitation facility run by the Department of Corrections. The judge in the case also sentenced her to pay restitution to her victims.</p>
